
事業(ye)單位的(de)(de)編外臨時人員(yuan),實行的(de)(de)是合(he)(he)(he)(he)同(tong)(tong)制(zhi)管理,依照的(de)(de)是《勞(lao)(lao)動(dong)合(he)(he)(he)(he)同(tong)(tong)法(fa)(fa)》,不(bu)管是財(cai)政統一供養(yang)的(de)(de),還是單位自主(zhu)招聘的(de)(de),其(qi)結果都是一樣的(de)(de)。按(an)照《勞(lao)(lao)動(dong)合(he)(he)(he)(he)同(tong)(tong)法(fa)(fa)》規(gui)定,事業(ye)單位改革,機(ji)構撤銷、整合(he)(he)(he)(he)等,都是合(he)(he)(he)(he)同(tong)(tong)主(zhu)體發生變化,符合(he)(he)(he)(he)《勞(lao)(lao)動(dong)合(he)(he)(he)(he)同(tong)(tong)法(fa)(fa)》規(gui)定的(de)(de)解除勞(lao)(lao)動(dong)合(he)(he)(he)(he)同(tong)(tong)的(de)(de)要素(su)和變更事項。事業(ye)單位改革后,對于(yu)編外人員(yuan)安置,是按(an)以(yi)下順序進(jin)行的(de)(de):
1、優先保證(zheng)事(shi)(shi)業單(dan)(dan)(dan)位(wei)編外(wai)人(ren)員就(jiu)業:事(shi)(shi)業單(dan)(dan)(dan)位(wei)可根(gen)據需(xu)要(yao),優先采(cai)取保證(zheng)原合同人(ren)員就(jiu)業的方(fang)(fang)式(shi)(shi),調整崗位(wei)、變更勞動合同等。機關(guan)事(shi)(shi)業單(dan)(dan)(dan)位(wei)改革中(zhong),對(dui)于編外(wai)人(ren)員安置,會根(gen)據實際需(xu)要(yao),由(you)人(ren)事(shi)(shi)部(bu)門統(tong)一簽訂(ding)勞動合同,分(fen)配各機關(guan)單(dan)(dan)(dan)位(wei)使用(yong);或者由(you)人(ren)事(shi)(shi)部(bu)門指定勞動派遣公司,派遣單(dan)(dan)(dan)位(wei)服務(wu),這兩(liang)類用(yong)工方(fang)(fang)式(shi)(shi),一般都由(you)當地財政(zheng)統(tong)一供(gong)養。部(bu)分(fen)有收(shou)入的單(dan)(dan)(dan)位(wei),主要(yao)是指醫院(yuan),可以由(you)人(ren)事(shi)(shi)、衛生主管部(bu)門同意后,由(you)用(yong)人(ren)單(dan)(dan)(dan)位(wei)自行招聘,自行供(gong)養。
2、對自(zi)主擇(ze)業(ye)(ye)(ye)(ye)(ye)人(ren)(ren)員(yuan)(yuan)(yuan)(yuan)進(jin)行補償(chang):對于愿意自(zi)主擇(ze)業(ye)(ye)(ye)(ye)(ye)、創業(ye)(ye)(ye)(ye)(ye)的人(ren)(ren)員(yuan)(yuan)(yuan)(yuan),或者因機構改革,無(wu)法繼續履(lv)行勞動(dong)(dong)合同(tong),需(xu)要解除勞動(dong)(dong)關系的編外人(ren)(ren)員(yuan)(yuan)(yuan)(yuan),根據(ju)《勞動(dong)(dong)合同(tong)法》規(gui)定(ding)(ding),按工(gong)作年(nian)限(xian)(xian)進(jin)行經濟補償(chang)。每工(gong)作一(yi)年(nian),補償(chang)一(yi)個月工(gong)資,包(bao)括使用(yong)十年(nian)以上(shang)的無(wu)固定(ding)(ding)期限(xian)(xian)勞動(dong)(dong)合同(tong)工(gong),都是如此補償(chang)。對于部分生活(huo)困(kun)難、就(jiu)業(ye)(ye)(ye)(ye)(ye)困(kun)難的人(ren)(ren)員(yuan)(yuan)(yuan)(yuan),可考慮(lv)安排(pai)公益崗位就(jiu)業(ye)(ye)(ye)(ye)(ye)。失(shi)業(ye)(ye)(ye)(ye)(ye)人(ren)(ren)員(yuan)(yuan)(yuan)(yuan)也可以按規(gui)定(ding)(ding)領取失(shi)業(ye)(ye)(ye)(ye)(ye)補助,在政府的引導(dao)下,重新(xin)就(jiu)業(ye)(ye)(ye)(ye)(ye)。就(jiu)業(ye)(ye)(ye)(ye)(ye)部門要加強失(shi)業(ye)(ye)(ye)(ye)(ye)人(ren)(ren)員(yuan)(yuan)(yuan)(yuan)技(ji)能培訓,幫(bang)助其盡快(kuai)尋找新(xin)的工(gong)作崗位。
3、勞(lao)務派(pai)遣(qian)工由勞(lao)務派(pai)遣(qian)公(gong)(gong)司安置:勞(lao)務派(pai)遣(qian)工不直接與機關事業單位發(fa)生關系(xi),其勞(lao)動關系(xi)在勞(lao)務派(pai)遣(qian)公(gong)(gong)司。因此,這(zhe)部分人(ren)員的安置,是由勞(lao)務派(pai)遣(qian)公(gong)(gong)司負責(ze)的。勞(lao)務派(pai)遣(qian)公(gong)(gong)司可以另行派(pai)遣(qian)新(xin)的崗(gang)位,也可以按(an)規定解除勞(lao)動合同關系(xi)。對于已經注銷或者破產的勞(lao)務派(pai)遣(qian)公(gong)(gong)司,則要由用人(ren)單位承擔連帶責(ze)任,進行補償。
機關事業單位改革中,按要求必須妥善安置涉改人員,尤其是編外臨時人員。要積極協調、幫助其自主擇業、創業,符合條件的可以提前將由社保部門保障,確保改革順利開展,同時也要保證社會穩定團結,人民生活不受影響。
